All, regrettably, our Judge Advocate has decided to step down. We appreciate his years in this roll and look forward to his future work with the DAV.
Currently, we are in need on a new JA. As our previous counsel has held this position for a number of years, it goes without saying several people do not know what the job entails. Below is the description of Judge Advocate from the Constitution and Bylaws. If you are interested I. Section 8.6: Judge Advocate
Para 1: The Judge Advocate is the legal advisor of the Department and will render opinions upon all legal matters and questions arising out of the Department or inter- Chapter disputes, upon request of the Department Commander or the DEC.
Para 2: Upon receiving the opinion of the Judge Advocate upon such question, the Commander will render a decision which is subject to appeal to the DEC and to the Department Convention.
Para 3: The Judge Advocate will pass judgment on the provisions of Chapter and Department Constitution and Bylaws and amendments thereto and approve same before they are forwarded to the National Judge Advocate for his approval.
Para 4: If in the opinion of the Commander, a matter might be placed before the Judge Advocate which could be construed to be a conflict of interest, it is the Commanders prerogative to instruct the Judge Advocate to refer the matter directly to the National Judge Advocate without comment.
Para 5: The Judge Advocate will serve as the Chairperson of the Constitution and Bylaws Committee.
