The expression "the inmates are running the asylum" is never more true that it is in Mecklenburg County. This story from WCOC veteran reporter Glen Counts is a case in point. The overall question - who protects the public when there are not enough police officers to be everywhere at once. The taxpayer supported Pretrial Release (PTR) plays fast and reckless with public safety (think shell game) serving as a conduit to put accused violent offenders back on our streets. Read and listen for yourself. https://www.wsoctv.com/news/local/police-woman-escapes-human-trafficker-in-pineville-2-people-charged/986063255

Two people have been arrested in connection with a human trafficking investigation in Pineville, police said.

This from long-time CMCW Volunteer, Cheryl Jones, who reflects on just one "alleged" very dangerous offender. Point: there is no justice from predators for innocent people (victims). It's lengthy, but worth a read. --------

Cheryl writes -

Normally I don’t look at Domestic Violence (DV) cases. Several reasons that I won’t go into here, but suffice to say they are more complicated, and have more “moving” parts than drugs, larceny, assault and yes, even murder.

Because of the issues this county has with bond amounts, I decided to look into TB Moss’ history. The following is a good picture of the bonds, or lack of bonds, in this county.

TB Moss was convicted in 1980 and1990 for Assault on a Female. In 1995, he was convicted for Assault with a Deadly Weapon (AWDISI). He was sentenced for the AWDISI to a minimum of 1 year 11 months and a maximum of 3 years 1 month. His sentence began in August of 1995 and parole began in Sept of 1999.

Only the last 3 years of arrests are shown on the sheriff’s website. The first arrest I’m able to see is in June 30, 2019. The arrest was for Assault on a Female. Unfortunately, this state (and most) consider assault on a female a misdemeanor, but, and this is very significant, this is a crime of which Mr. Moss had been convicted twice. The magistrate who can see the record and in their infinite wisdom, issued a $2,000 secured bond. Moss bonded out July 2, 2019.

On July 3, 2019, Moss was arrested again. This time for two Domestic Violence (DV) Protective Order Violations. July 8, 2019, while he was still in jail, he was served with another Domestic Violence (DV) Protective Order Violation and Harassing Phone Calls. In case you’re not keeping score, that’s *three* Domestic Violence (DV) Protective Order Violations and one Harassing Phone Call charge.

HE WAS RELEASED ON PRE-TRIAL RELEASE! The victim went to the courthouse, got a Domestic Violence (DV) Protective Order against him. As a rule, people don’t get a Protective Order against someone unless they are afraid of that person. When Mr. Moss appeared in court on July 11, 2019, the Pre-Trial Release (PTR) people were there and asked the judge to release him on PTR. The judge agreed. Mr. Moss walked out of the jail July 15, 2019. I don't know why it took him another 4 days to be released, but it did.

TB Moss is a prime example of what I’ve been saying for years – THE MAGISTRATES AND SOME JUDGES DON’T GIVE THESE CRIMINALS AND THEIR POTENTIAL OF BEING A THREAT TO THIS COMMUNITY ANY CONSIDERATION UNTIL THEY KILL OR ATTEMPT TO KILL SOMEONE. It has happened.

July 22, 2019, Mr. Moss proved my point. His “alleged” crimes are: Attempted 1st Degree Murder, Carrying a Concealed Weapon – Gun, 3 charges of Discharging a Firearm in the City, 4 charges of Discharging Weapon in Occupied Property, Domestic Violence (DV) Protection Violation with Deadly Weapon, Stolen Firearm, Possession of Firearm by Felon and Resisting Public Officer. His bond for these charges is over $600,000/secured.

It is “alleged” he shot his victim, a city bus driver, at the public transit center. He is charged with with the crime, carried out in broad daylight (12:30 p.m.) Police found him not far from the scene and he had a gun.

Some in the media speculate he won’t be getting out of jail anytime soon because of his high bond. Where there is a will there is a way. If he wants to get out bad enough, he’ll find people to put up their homes, cars, anything they have of value to secure his bond. And, a sympathetic will order he be put on Electronic Monitor (EM) I’ve seen it happen many times before. The EM would last about as long as it takes Mr Moss to cut it off.

The burning question: Why was his bond for the Assault on a Female only $2,000/secured when he had been convicted twice for this? It's public record. Why was he given PTR and allowed to walk out of the jail for violating the Protective Order against him – not once, but 3 times – and had made Harassing Phone Calls. According to the victim, he had threatened to kill her and her family and had called her cellphone 100 times.

What will it take for our magistrates and most of our judges to consider the rights of the public to be protected from these thugs? Do they or, God forbid, one of their loved ones have to become a victim? When are we going to start holding our Criminal Justice System, beyond the police who have *done* their jobs, accountable for the safety of innocent people?

WCNC News, had an excellent feature piece that underscores the ongoing failure of the criminal justice system. And leading the way - local magistrates - some puffed-up government employees who do nothing to protect the public from some very dangerous people - criminals with proven track records. Innocent people die as a result. https://www.wcnc.com/video/news/investigations/investigators/convicted-murderer-accused-of-killing-again/275-e03368a7-9da7-4e3a-8a5c-3c5e098a2152?jwsource=em

Police said 47-year-old John Songer was hit by a stray bullet outside a local bar. The suspect, Jamie Harris previously spent 10 years in prison for a different murder.

When immigration populist Sheriff Garry McFadden promised to not cooperate with Federal law enforcement officers (ICE) when it came to illegal immigrants, he put hard-working law-abiding immigrant's safety at risk. Instead of precision surgical arrests of illegals by ICE, those who are not a risk to the community get caught up in the blanket enforcement action. The naive "community activists" believe Federal ICE agents have no jurisdiction to arrest illegals in Mecklenburg. The activists are simply lying to the immigrant community. https://www.wsoctv.com/news/local/ice-agents-arrest-man-charged-with-impersonating-officer-in-meck-county-courthouse/905536912

ICE agents arrest man charged with impersonating officer in Meck. County courthouse

A Charlotte Observer editorial profiling those who want to become a District Court Judge, took notice of WBTV News’ Nick Ochsner’s investigative story (without credit to Ochsner) to give a strong thumbs up to Assistant District Attorney Karen McCallum. Her District is 26-F.

McCullum is an Army Veteran and Senior Prosecutor in the D.A.’s office. Her boss, the D.A., gives her two thumbs up. CharMeck Court Watch, echoes and underscores that sentiment!

The other candidate, Khalif Rhodes, is the county’s Chief Magistrate. He has played fast and reckless with the law regarding bonds. This has resulted in some serious criminal offenders being loosed on the community. And, as an officer of the court, i.e., an attorney, he has a documented record of not complying with the law when it comes to required reports to the State. CharMeck Court Watch was pleased the Observer recognized Karen McCallum as the person we should select to be a District Court Judge.

A candidate for District Court Judge cannot abide by the law and yet people will vote for him. WBTV News' Nick Ochsner's report makes one wonder how Mecklenburg Chief Magistrate Khalif Rhodes was ever appointed to his position - a position whereby he advocates for no bond and release on a promise to return to court for those accused of violent crimes. https://www.wbtv.com/2018/10/18/judge-candidate-accepted-campaign-contributions-while-campaign-was-suspended-records-show/

A local candidate for Judge accepted campaign contributions and paid expenses from his campaign account while his campaign was terminated from active status by the North Carolina State Board of Elections, records show.

If there was ever a case of the inmates running the asylum, craziness from the Mecklenburg County Magistrates's office, backed by the Chief District Judge Regan Miller, is a classic example of public safety being hung out to dry. If one looks at the WBTV News story, the Chief District Judge smirk and answer should tell where he stands on holding people accountable. He doesn't. https://www.wbtv.com/2018/10/16/top-judge-says-most-criminal-defendants-should-be-free-before-trial/

A top Mecklenburg County judge is defending the recent practice of the county’s magistrates of letting criminal defendants charged with felony crimes free while awaiting trial by issuing a summons instead of sending them to jail and giving them bond.

This is one of the reasons people need to be more aware of those seeking office and their stand on issues affecting innocent people. Unfortunately, because the Legislature restructured (destructed, maybe) how we vote on judges, the majority of the voters will not be able to vote against this nonsense candidate. Now, like all judges, he runs in a narrowly defined district (called political Wards in some cities, like Chicago). https://defensemaven.io/bluelivesmatter/news/magistrates-refuse-to-sign-warrants-for-armed-robbers-rapists-citing-racism-ZPBMiQXypUKP7IapV_U3IQ/

Judges in Mecklenburg County, led by Chief Magistrate Khalif Rhodes, have stopped issuing most arrest warrants.
