Attorney Kaci and Paralegal Ren secured long term disability benefits from The Prudential Insurance Company of America after the claim was initially denied. Prudential denied the claim by taking the position that the client could still perform her own occupation as a CEO.
The client had managed chronic Crohn’s disease for many years, but her symptoms eventually became too severe and too frequent for her to continue working. Because her occupation required extensive travel, the severity and unpredictability of her condition prevented her from reliably performing the material duties of her job.
On appeal, our team submitted evidence proving that the client could not perform her occupation as a CEO, especially given the travel demands required by her role. Based on that evidence, Prudential overturned its denial and approved her long term disability benefits.
