Artificial Intelligence Chatbots and Mental Health

Many states have passed or introduced legislation to limit the use of artificial intelligence (AI) chatbots in the mental health care system due to concerns about the potential risk they may pose to patients and the integrity of mental health services.


The following states have enacted laws surrounding the use of AI in mental health care:

Illinois — House Bill (HB) 1806 ensures that only licensed professionals can claim to offer therapy services and limits how often licensed professionals can use AI in therapeutic treatment.
Nevada — Assembly Bill (AB) 406 prohibits the use of AI for direct mental or behavioral health treatment in Nevada public schools and by unlicensed individuals. The law allows AI use for administrative support.
New York — AB A8884 prohibits AI systems from making consequential decisions, including those related to mental health care.
Utah — HB 452 establishes protections for mental health chatbot users, such as privacy protections and requirements for maintaining mental health chatbots.

"Illinois recently banned the use of artificial intelligence in mental health therapy, joining a small group of states regulating the emerging use of AI-powered chatbots for emotional support and advice. Licensed therapists in Illinois are now forbidden from using AI to make treatment decisions or communicate with clients, though they can still use AI for administrative tasks."
