Synopsis: Last year, Stanley Kuligowski filed a petition against the State for their refusal to issue him a medical ma*****na card. Suing in Merrimack Superior Court, he seeks an immediate injunction ordering the DHHS to begin accepting patient and caregiver applications, and issuing registry identification cards.
NH DHHS has indicated that they are barred from issuing cards prior to the ATCs (dispensaries) being fully operational. They have stated that their policy of non-issuance of cards is a "statement of the law" and not a "rule" by definition, therefore it was not subject to the requirements of the Administrative Procedure Act.
This Sunday, Petitioner Kuligowski will argue his position in a mock-hearing, with Jay Leherif representing the State. Mr. Craig Meriwether will preside over this mock hearing. You are invited to attend and comment about the proceeding.
The goal is to help Mr. Stanley Kuligowsky become proficient at arguing his position and to be prepared to deal with the stress of the unknown, court procedures, and observers in the background.
