Separation can be a difficult process to maneuver on your own. There are numerous documents and details needed which can intimidate people into thinking a lawyer is their only option. However, a mediator can help with this confusion by walking you through the process and writing up important documents without the court making decisions for you. One of the best books to read that centers around conflict resolution is Getting to Yes, written by Roger Fisher, William Ury & Bruce Patton. The book introduces the concept of “principled negotiation,” which focuses on finding mutually beneficial agreements through cooperation rather than confrontation. If you’re not up for reading the whole thing here are it’s principals for you to reference next time you find yourself in conflict or need to negotiate.

1. Separate the People from the Problem: Negotiators should address the issue at hand without letting personal feelings or relationships interfere. Keeping emotions in check allows for a more objective approach.
2. Focus on Interests, Not Positions: Rather than sticking to fixed demands (positions), the key is to understand the underlying needs and interests of both parties. This opens up space for creative solutions.
3. Generate Options for Mutual Gain: Both parties should brainstorm a variety of possible solutions that can benefit everyone, rather than insisting on just one path forward.
4. Use Objective Criteria: Agreements should be based on fair, independent standards (such as market value, legal precedent, etc.) to avoid subjective or biased decisions.
5. BATNA (Best Alternative to a Negotiated Agreement): It’s crucial to know your best alternative to a deal in case negotiations fail. This provides leverage and helps prevent settling for unfavorable terms.

Andrew got his start as a volunteer mediator with Akron Municipal Court. He completed his mediation training through the Ohio Supreme Court in January of 2017 in general mediation, as well as specialized family and divorce mediation. Andrew is on the referral list of mediators for Summit County Domestic Relations Court. Andrew received his B.A. in Psychology in 2012 and is a co-founder and partner in Evolve Services where he works with clients who are struggling with memory, attention, reading, and other cognitive skills.
