It is with heavy hearts that we share the news of the passing of our co-worker and friend, Wendy Dotzenrod-Ney. We will miss her dearly and pray for comfort for all of her family and friends.

This week the IRS released guidance to allow changes to Section 125 cafeteria plans, including the ability to make mid-year election changes to a health FSA or Dependent Care Assistance Program (DCAP). In addition to these election changes, an extension of time to claim the funds in the account can also be permitted in both the FSA and DCAP.

Are you an employer taking advantage of the Families First Coronavirus Response Act (FFCRA)? Don’t forget that these payments to your employees are WAGES and therefore your employee’s normal pre-tax payroll deductions should continue to apply:

“All other payroll deductions should continue to be taken out of emergency FMLA leave and emergency paid sick leave. Only Congress can change the definition of “wages” under federal law and, with respect to FFCRA emergency leave payments, it has done so only for the purposes of the social security portion of F**A – in other words, not for contributions to tax-favored retirement plans like 401(k) or 457 plans.”

The Cares Act was signed into Law on March 27, 2020. Among many things contained in this act, there are provisions of this act that may affect your Retirement Plan (Coronavirus related distributions and/or loans as well as the suspension of RMDs for 2020) and also your FSA/HSA (reimbursement of OTC medical products as well as certain feminine care products without prescription).
