EEOICPA Claim Steps: From Filing to Care
Determine Eligibility
Worked at a covered DOE facility, atomic weapons employer, or beryllium vendor
Diagnosed with a covered illness (e.g. cancer, beryllium disease, silicosis, chronic respiratory illness)
Exposure occurred during employment at a covered site during an approved time period
🔍 Use the DOE Facility List and Site Exposure Matrix (SEM) to confirm.
2. File a Claim with the U.S. Department of Labor (DOL)
Fill out and submit:
EE-1 (for employees) or EE-2 (for survivors)
EE-3 (Employment History Form)
Supporting documentation:
Medical records
Proof of employment (pay stubs, DOE verification, co-worker affidavits)
Physician diagnosis and exposure link (for Part E)

3. Complete the Occupational History Questionnaire (OHQ)
DOL or Resource Center conducts a 1:1 interview to document:
Job roles, work areas, exposures, protective equipment used
This step helps build the case for toxic substance exposure
4. Claims Review & Decision Process
Your claim is reviewed by the District Office
For Part B (radiation-related cancers), DOL may refer to NIOSH for a dose reconstruction
A Recommended Decision is issued
You can:
Accept the decision
Object or request a hearing within 60 days
5. Final Decision by FAB (Final Adjudication Branch)
FAB reviews the file and issues a Final Decision
If approved, compensation and medical benefits are authorized
If denied, you can request reconsideration or reopening with new evidence
6. Receive Compensation & Medical Benefits
Depending on the part of the program:
Part B
$150,000 lump sum
Full medical coverage for accepted illness(es)
Part E
Wage loss benefits (up to $250,000 total with impairment and wage loss)
Medical expense coverage
Survivor benefits if illness contributed to death
