We have seen this play out in other states. Bills to ban pharmacies from owning PBMs can have bipartisan support, be signed into law by the governor and still be shot down by the courts. CVS always finds a way…
As reported by Chris Davis NewsChannel 5:
Alright, fair warning here, this is a complicated bill but could have a huge impact on all of us.
Sen. Bobby Harshbarger, an East Tennessee Republican, wants to ban pharmacies from also owning PBMs or Pharmacy Benefit Managers.
Simply put, PBMs are essentially middle men that negotiate prescription drug prices between pharmacies and the insurance companies.
Independent pharmacists will tell you, having one company that owns both ends of those deals is a conflict of interest, and they simply can't compete.
CVS is one of those big pharmacies, that also owns a PBM called Caremark. They say, if this bill passes, they may be forced to shut down all 134 of their Tennessee locations. That could leave several communities, especially in urban areas, without a close pharmacy. Not to mention, a lot of pharmacists could be out of a job.
The measure advanced in the Senate Health Committee today, which interestingly enough, features three either current or former pharmacists on the panel. They all support the PBM Pharmacy ownership ban.
But a CVS employee tells me, he hopes they can reach some sort of compromise. "I think there’s always ways to have conversations about things beyond taking the far extreme option that we’re having here that results in the closing of all of our facilities in the state," said Adam Rodgers.
What do you think? Would you be impacted by a CVS Pharmacy closure? Do you think it's a step that's needed to help the independent pharmacies?
