It's now been 45 years the Arc Of North Dakota has been advocating, facilitating, and educating on behave of our neighbors, friends, and the entire community of people in ND with IDD.
43 years ago today, on September 26, 1980, a momentous event unfolded in North Dakota. The Arc of North Dakota and six individuals with intellectual disabilities and their guardians initiated a landmark class action lawsuit against the state. Filed in the United States District Court for the District of North Dakota, this legal action targeted the treatment and conditions within the Grafton State School, now known as Life Skills and Transition Center in Grafton, North Dakota.
In November 1981, both sides agreed to improve things at the school. The state of North Dakota promised to use fewer medications, stop hitting people, use fewer physical restraints, ensure everyone got good food and care, and hire more staff.
Unfortunately, the state didn't keep its promises. In 1982, the judge made strict rules to make sure the rights of people with disabilities were protected. These rules included making individual plans for residents, giving them proper food, shelter, and healthcare, and ensuring their privacy.
It took the state of North Dakota 15 years to show enough progress for the case to be closed. In 1996, The Arc of ND lost an appeal for legal fees. The Supreme Court declined to hear the case.
As we reflect on this significant chapter in North Dakota's history, it's essential to recognize that the fight for the rights and well-being of individuals with intellectual disabilities did not end with the conclusion of this legal battle. The Arc of North Dakota, an organization dedicated to advocating for the rights and opportunities of individuals with intellectual and developmental disabilities, has played a vital role in the ongoing advocacy efforts across the state. Over the past four decades, The Arc of North Dakota has tirelessly championed the cause of inclusion, equality, and improved quality of life for individuals with disabilities. Through educational programs, support services, and policy advocacy, they have continued to make a positive impact on the lives of countless North Dakotans with disabilities. As we move forward, it is clear that The Arc of North Dakota will remain at the forefront of this vital work, ensuring that the rights and dignity of individuals with disabilities are upheld and advanced throughout the state.
