Dear Governor Hutchinson (or To Whom It May Concern),
On March 17, 2020, you issued EO 20-06, ordering state agencies to “identify provisions of any regulatory statute, agency order or rule that in any way prevents, hinders, or delays the agency’s ability to render maximum assistance” to Arkansans during the COVID-19 health emergency. The Order instructed state agencies to identify regulatory statutes, orders, and rules that are hindering or preventing the rapid response necessary to combat the spread of and recovery from COVID-19. The Order requires agencies to identify any such statutes, orders, or rules on its website. Once posted, the statute, rule, or order is deemed suspended for thirty (30) days from the effective date of EO 20-06. EO 20-37 terminated EO 20-03 and the EO 20-06 amending that EO. EO 20-37 has been renewed throughout the last several months and was renewed again today via EO 21-07. However, this last executive order does not list 20-06 regarding "provisions of any regulatory statute, agency order or rule that in any way prevents, hinders, or delays the agency’s ability to render maximum assistance”.
The LLM (Licensed Lay Midwives) in this state have been notified just today that this most recent executive order declaring an emergency state (EO 21-07) will not encompass our clients safety any longer via the suspension of certain rules pertaining to care under LLM. The suspended rules for LLM allow families utilizing the services of LLM to keep themselves safe during this global pandemic which in turn keeps all LLM clients safe. The emergency state and global pandemic has not ended as evidenced by this recent EO 21-07. The fact remains that our state has an over 3x higher number of daily cases than it did when the emergency order was enacted.
March 31, 2020: 56 new COVID19 cases
March 30, 2021: 178 new COVID19 cases
Arkansas citizens ask that the rules which have been suspended throughout the last year continue to be suspended for the duration of the emergency state and while there is a global pandemic to ensure the safety of our families choosing homebirth.
