Setting the Record Straight About Tennessee SB 2040/ HB 1959
"Freedom, Access, and Integrity in Registered Pharmacy (FAIR Rx) Act." - Amends TCA Title 63
There has been too much misinformation circulating that Tennessee Senate Bill 2040 is a bill designed to “close all CVS pharmacies in TN.” That claim is simply not true. It is pure fearmongering by cooperation mega dollars.
This bill does not close, ban, or revoke the license of any pharmacy — including CVS, Walgreens, independent pharmacies, or grocery store pharmacies.
This legislation addresses Pharmacy Benefit Managers (PBMs) — the middle companies that manage prescription drug benefits for insurance plans and employers. PBMs control reimbursement rates, pharmacy networks, and pricing structures. The bill focuses on transparency and fairness in those practices.
It is important to understand:
• Pharmacies and PBMs are NOT the same thing.
• Regulating PBM practices does not shut down pharmacies.
• All licensed pharmacies would continue operating under Tennessee law.

Some have also brought TRICARE and or veterans into this fear. TRICARE is a federal Department of Defense health program for military families. Federal programs like TRICARE operate under federal law and contracts. Tennessee SB 2040 does not eliminate TRICARE pharmacy access or “remove” military families from receiving care. Service members, veterans, and their families would continue to receive their pharmacy benefits as determined by federal program rules.
At its core, this bill is about:
• Protecting patient access and choices.
• Increasing transparency
• Ensuring fair reimbursement practices for ALL Pharmacies
• Supporting healthcare access in both rural and urban communities
This conversation should be grounded in facts, not fear. When fear makes the decision, wisdom has left the room.
