Indiana APSE:  Advancing Employment, Connecting People IN-APSE is a state chapter of APSE: Association for People Supporting EmploymentFirst. APSE has chapters in 35 states and the District of Columbia.

APSE members come from all 50 states and Puerto Rico, as well as several foreign countries. IN-APSE: Association for People Supporting Employment is a membership organization formed in 1988 as the Indiana Association for Persons in Supported Employment to improve and expand integrated employment opportunities, services, and outcomes for persons experiencing disabilities. APSE is the only national association focusing solely on expanding integrated employment for individuals with disabilities.

Waiver amendment public comment announcement July 2025

To ensure continued alignment among all DDRS HCBS Waivers in support of the ongoing BDS Waiver Re-set project; The Division of Disability and Rehabilitative Services Bureau of Disabilities Services would like to announce a public comment opportunity for upcoming amendments to the Community Integration and Habilitation waiver, Family Supports waiver, Health and Wellness waiver and Traumatic Brain Injury waivers.

Public notice and comment occur prior to submitting amendments to Centers for Medicare and Medicaid Services (CMS) and ensure that everyone can share thoughts, concerns, or questions about the proposed amendments. With a projected effective date of December 2025, the public comment period will be open beginning July 9 through August 8, 2025. Many of the changes and updates being implemented are the result of active stakeholder engagement and feedback the bureau has received from individuals, families and our Home and Community Based Services providers as well as working to build a sustainable system of services and support.

Waiver specific fact sheets with the proposed changes are currently posted here: https://tinyurl.com/yxxetwuw. The complete waiver amendments will be posted on July 9, 2025 to align with the public comment period. A separate announcement will be released on that date with instructions on where to submit public comments.

Highlights of the proposed amendments across all HCBS waivers include:

• Add Benefits Counseling Service
• Combine Home Modification and Home Modification
Assessment Services
• Implement new self-direction options for select services
• Implement limit for services to a maximum of forty (40) hours per week per paid caregiver that may be provided by Relatives and Legal Guardians.
• Make technical changes to support alignment across multiple HCBS waivers operated and administered by the Division of Disability and Rehabilitative Services (DDRS)

CIH & FSW WAIVER:

• Implement use of new ICF/IID LOC assessment tool
• Reconfigure Behavior Support Services, including the elimination of Intensive Behavioral Intervention service
• Implement new limits for Music Therapy service and Recreational Therapy service
• Discontinue Enrollment in Facility-Based Prevocational Services
• Add DSP Registry and Training Requirements required by state legislation

HEALTH AND WELLNESS WAIVER:

• Add Extended Services
• Implement limit for services to a maximum of forty (40) hours per week per paid caregiver that may be provided by Relatives and Legal Guardians.
• Discontinue the Participant Directed Home Care Services (PDHCS) pilot and implement an updated model for select services
• Remove the Home Health Agency license requirement from Attendant Care, Home and Community Assistance, Integrated Health Care Coordination, Specialized Medical Equipment and Supplies, and Transportation
• Remove the Personal Service Agency license requirement from Integrated Health Care Coordination, Specialized Medical Equipment and Supplies, and Transportation.

TBI WAIVER:

• Revise Residential-Based Habilitation service to allow individuals living with housemates to use a shared staffing model
• Implement limit for services to a maximum of forty (40) hours per week per paid caregiver that may be provided by Relatives and Legal Guardians.
• Revise and rename Supported Employment services definition to align with Extended Services definition on other waivers operated and administered by the Division of Disability and Rehabilitative Services (DDRS)
• Remove the Home Health Agency license requirement from Attendant Care, Home and Community Assistance, Integrated Health Care Coordination, Specialized Medical Equipment and Supplies, and Transportation
• Remove the Personal Service Agency license requirement from Integrated Health Care Coordination, Specialized Medical Equipment and Supplies, and Transportation.
As required by Federal Law (42 CFR 441.304) there will be a 30-day notice for public comment to ensure timeliness.

NEW SOCIAL SECURITY OVERPAYMENT INFORMATION
(Rules and Overpayment form)

SSA Will Now Default to 50 Percent Withholding Rate to Recover SSDI Overpayments
Note: The maximum withholding rate for SSI overpayments remains at 10 percent.
Effective April 25, 2025, “overpayment notices will provide a default Title II [SSDI] overpayment benefit withholding rate of 50 percent of the monthly benefit.” Social Security Emergency Message, EM 25029 (4/25/25).
This change overrides the SSA blog announcement on 3/7/25 posting that SSA was returning to a 100 percent default withholding rate from current benefits (rescinding a 10 percent withholding rate that was announced in March 2024).
What About Overpayments in Existence Prior to 4/25/25?
The 4/25/25 EM states: “If an overpaid individual has a prior overpayment and incurs a new overpayment, all outstanding overpayments will default to 50 percent benefit withholding at the end of the approximately 90-day period if the individual does not request reconsideration, a waiver, or negotiate a lower repayment rate.” (emphasis added) If there is no new overpayment, withholding should continue at the current rate.
What NABWIS Members Can Do:
Advise beneficiaries of 3 key rights when they get an overpayment notice:
Appeals – starting with a Request for Reconsideration, to challenge whether an overpayment occurred, or challenge the overpayment amount. Be aware of the 60-day time limit for appealing.
Request for Waiver – asking SSA to not collect the overpayment, typically by showing: 1) without fault, and 2) inability to repay. You can request a waiver at any time. Check the POMS for new rules explaining when Social Security will presume no fault in creating the overpayment.
Request a Lower Rate of Repayment – This can be requested at any time. As circumstances change, the rate of repayment can be lowered more than once based on inability to pay. Repayment rates as low as $10 per month can be granted. Beneficiaries can use Form SSA-634, “Request for Change in Recovery Rate” to submit their request.
