A QUICK OVERVIEW OF THE WASTE REFUND ACT: Required CMS Refunds Effective January 1, 2023.

As part of the infrastructure bill passed in 2021, the Waste Refund Act requires drug companies to reimburse Medicare for certain wasted medications leftover in single-use containers.

Healthcare facilities (hospitals, ASC's, etc.) that do not report their wastage refunds correctly could be at risk of failed audits and being charged with healthcare fraud.

ALERT: Temporary Placement of Etizolam, Flualprazolam, Clonazolam, Flubromazolam, and Diclazepam in Schedule I

ACTION: Temporary amendment; temporary scheduling order.

SUMMARY: The Administrator of the Drug Enforcement Administration is issuing this temporary order to schedule five synthetic benzodiazepine substances: etizolam, flualprazolam, clonazolam, flubromazolam, and diclazepam, in schedule I of the Controlled Substances Act. This action is based on a finding by the Administrator that the placement of these five substances in schedule I is necessary to avoid imminent hazard to the public safety. As a result of this order, the regulatory controls and administrative, civil, and criminal sanctions applicable to schedule I controlled substances will be imposed on persons who handle (manufacture, distribute, reverse distribute, import, export, engage in research, conduct instructional activities or chemical analysis with, or possess) or propose to handle these five specified controlled substances.

DATES: This temporary scheduling order is effective July 26, 2023, until July 26, 2025. If this order is extended or made permanent, DEA will publish a document in the Federal Register.

The Substance Abuse and Mental Health Services Administration (SAMHSA) has dedicated May 7-13, 2023 as National Prevention Week. The goal of this week is to increase public awareness and prevention of mental health, and substance use disorders.

SAMHSA is an agency of the U.S. Department of Health and Human Services and is responsible for reducing the impact of substance abuse and mental illness on America's communities. They provide resources and support to healthcare providers, educators, and communities to prevent and treat mental and substance use disorders.

During National Prevention Week, SAMHSA encourages communities to organize events and activities that promote prevention and reduce the risk of mental and substance use disorders. This year's theme is ""Prevention Works, Treatment Is Effective, Recovery Is Possible,"" which emphasizes the importance of prevention, treatment, and recovery for individuals and communities.

SAMHSA has created a toolkit to help organizations plan and promote National Prevention Week. The toolkit includes ideas for events and activities, social media graphics and messages, and resources for mental and substance use disorder prevention. Have questions about EPA's Management Standards for Hazardous Waste Pharmaceuticals Final Rule?
EPA has two primary reasons for introducing this final rule.

1. Address concerns raised by stakeholders regarding the difficulty in implementing the industry-oriented Resource Conservation and Recovery Act (RCRA) hazardous waste regulations for the management of hazardous waste pharmaceuticals generated at healthcare facilities and managed at reverse distributors.

2. A number of studies have documented the presence of various pharmaceutical active ingredients and metabolic by-products in surface waters and groundwater in the United States. The pharmaceuticals entering the environment, through flushing or other means, are having a negative effect on aquatic ecosystems and on fish and animal populations.
