Chris Tucker Contracting was hired to replace faulty ADA handicap ramps and surrounding concrete. In less than a year after installation, the concrete job, began to degrade, deteriorate, and break apart. Soon after installation, a large piece of concrete fell off the ramp and received an unacceptable "patch". This patch of concrete also fell off the ramp. This is unacceptable work and clearly it was not installed in a good and workmanlike manner. The owner has repeatedly stated on numerous occasions both verbally and in print, the work would be corrected, but as of this writing the problem remains in disrepair and creates a hazard to patients and employees.
At present, the contractor was served with legal notice from my attorney to tear out, repair, and replace the defective concrete work previously installed and paid in full.
Legal action will be initiated for damages for breach of contract, breach of warranty, violations of the Texas Consumer Protection Act, and recovery of its attorney fees effective September 26, 2022.
