Is Human Composting legal in New Jersey?

Yes, human composting is legal in New Jersey, following the passage of a bill that allows for natural organic reduction, also known as human composting. The law, signed in September 2025, permits funeral homes and other facilities to offer the service locally, with the state overseeing licensing and regulation.

• Legalization: New Jersey is the 14th state to legalize natural organic reduction.
• Timeline: Funeral homes and facilities can offer the service within the next 10 months.
• Regulation: The state will oversee licensing and regulation of the facilities.
• Process: The method involves the controlled decomposition of human remains to create soil.
• Availability: This allows New Jersey residents to use this alternative to traditional burial and cremation locally, rather than traveling to states where it was previously legal.

🏡 Thinking about a home burial in NJ? We had a family make an inquiry regarding this and the location that they could do so, they wanted to know if they could bury a loved one in their backyard specifically and we will like to share the answer with you all.

You cannot bury someone in your backyard in New Jersey; burials must take place on land specifically designated and licensed as a cemetery. To use private land for burial, it would have to be officially established as a family cemetery, which requires obtaining a Certificate of Authority from the New Jersey Cemetery Board, and following rigorous zoning and environmental regulations. A licensed funeral director is also required to be involved in any burial in New Jersey.

• State Law: New Jersey law requires that burials occur on property dedicated for cemetery purposes.
• Licensing Required: To create a cemetery on private property, you must apply to the New Jersey Cemetery Board for a Certificate of Authority to operate a "cemetery company".
• Family Cemeteries: Creating a family cemetery is possible but is not a simple process and involves adhering to strict zoning laws and environmental regulations.
• Funeral Director Involvement: A licensed funeral director is required to be involved in all burials in New Jersey, even if the burial is on private land. They are responsible for handling the death certificate and other required procedures.

Still, you can personalize your loved one’s farewell beautifully and we would be honored to assist your family make it a stressless and comforting experience.
