Important DOT Compliance Update – Ma*****na Rescheduling

President Trump signed an executive order on December 19 directing federal agencies to expedite moving ma*****na from Schedule I to Schedule III. While the issue is making headlines, what this DOES NOT DO is just as important—especially for DOT-regulated employers and drivers.

➡️ Ma*****na is NOT federally legalized.
➡️ DOT drug & alcohol regulations have NOT changed.
➡️ Safety-sensitive employees are still subject to current testing rules—for now.

This shift raises serious regulatory questions. DOT drug testing authority is tied to Schedule I & II substances, and ma*****na currently accounts for nearly 60% of positive tests among commercial drivers. Rescheduling could create a regulatory gap if federal agencies do not act quickly to clarify enforcement.

Until DOT issues formal guidance, DO NOT ASSUME testing requirements have changed. Acting prematurely could expose your business to compliance violations and safety risks.

Last week, the House passed legislation banning assault weapons. The vote is largely viewed as a symbolic step by the chamber as the measure with likely fail in the Senate. Five democrats notably voted against the bill, while two Republicans voted in favor. The bill would ban the sale, import manufacture or transfer of specific semi-automatic weapons. However, the legislation does not call for the removal or confiscation of weapons currently owned.
