PBM Enforcement Update

The TN Dept. of Commerce & Insurance (TDCI) just took action against two major PBMs:

* Express Scripts (ESI) fined $250K for 12 violations, including underpaying pharmacies, favoring affiliates, and illegal recoupments.
* Caremark fined $750K (3 separate $250K fines) for failing to report key info on MAC lists, networks, appeals, claims & audits—even after extensions.

At the time, $250K was the maximum fine allowed. But starting May 2025, that cap is gone, thanks to TPA-backed legislation (HB 1244).

Future violations could come with much steeper penalties.

The Texas State Board of Pharmacy has issued guidance for the emergency dispensing of prescription medications as a result of last weekend's flooding in the Texas Hill Country.

In the event of a natural or manmade disaster, the Texas Pharmacy Act (Sec. 562.054) and Board rule 291.34 allow a to dispense up to a 30-day supply of a prescription drug, other than a Schedule II controlled substance, without the authorization of the prescribing practitioner under certain conditions.https://www.pharmacy.texas.gov/files_pdf/2025-Flood-Notification.pdf

HB 196 has passed out of the Georgia House of Representatives with a vote of 168-0. The bill would require all State Health Benefit Plans and University Systems to reimburse pharmacists using a transparent, index based price, plus a dispensing fee (NADAC plus $10.64). It now goes to the Georgia Senate on Monday for consideration.

A very big thank you to our members for mobilizing and calling their representatives, making sure they know how critical fair and equitable reimbursement is to all of our pharmacies in the state.
