🚨 KANSAS UPDATE: KRATOM & DELTA-8 UNDER THREAT

This week in Topeka, multiple bills are moving that could dramatically impact kratom and hemp-derived products in Kansas.

🔴 SB 497

Would add kratom and Delta-8 THC to Schedule I under the Kansas Controlled Substances Act — effectively banning them.

It is scheduled for hearing in Senate Public Health & Welfare.

If passed, this would criminalize products currently sold legally across Kansas.

🟡 HB 2230 – Kratom Consumer Protection Act

This bill would:
• Define kratom as a food product
• Require labeling and safety standards
• Prohibit adulterated/contaminated products
• Restrict sales to 21+
• Impose fines and enforcement

⚠️ This is regulation — not a ban.

🟢 SB 292 (The regulatory framework we’ve been working on)

This bill:
• Focuses on reasonable regulation
• Addresses product safety
• Separates kratom from high-potency synthetic derivatives

It has NOT yet been brought to committee.
It needs a sponsor to request a hearing.

⚠️ The Real Issue: 7-Hydroxymitragynine (7-OH)

There is growing concern about concentrated 7-OH products:

• Reported to be 43x stronger than raw kratom
• Up to 13x stronger than morphine
• Often referred to as “gas station heroin”

Legislators are attempting to tie 7-OH to kratom broadly.

If that happens:
• It creates a domino effect
• Kratom could be scheduled
• Delta-8 could be wiped out in the same move

This is a policy bundling strategy.
