The ACLU is urging transgender people who need to update the gender marker on their U.S. passport to act now and apply as soon as possible.
This warning comes amid a legal challenge - Orr v. Trump - that could roll back the current policy allowing people to self-select the gender marker on their passports without medical documentation.
The State Department has begun complying with a preliminary injunction issued in June, but if the court sides with the Trump administration’s push to reinstate invasive medical certification requirements, it could become much harder for trans Americans to obtain accurate ID documents.
This isn’t just about paperwork. Accurate ID is essential for travel, safety, healthcare access, housing, and dignity.
If you or someone you love needs to update their passport, do not wait. The ACLU recommends submitting applications now to avoid potential new barriers.

Dr. Avi Vieira offers therapeutic support for members of the LGBTQ+ community and those that love them. We work with individuals of all sexual orientations and gender identities, including those who are in the process of exploration and discovery of their authentic selves.
Dr. Avi is a Post-Doctoral Resident and currently runs the Gender and Sexuality Services Program at Oasis Psychological Services. They earned their Psy.D. in Clinical Psychology from the Arizona School of Professional Psychology at Argosy University. I am an early career member of the World Professional Association for Transgender Health (WPATH) and the American Psychological Association’s Society of Sexual Orientation & Gender Identity (Division 44). They are also a member of the Arizona Psychological Association and representative of the LGBTQ committee, having been a co-founder of the Phoenix Chapter of the committee. In 2016 Dr. Avi published their dissertation on the use of the MMPI-2-RF as a tool in the assessment of Trans and Gender Nonconforming individuals, which helped to create a professional questionnaire assessment and new standard for affirming care for individuals seeking transition services. During their predoctoral clinical internship at the University of Colorado - Boulder, Dr. Avi helped to create an interdisciplinary treatment team for transgender concerns, consisting of licensed psychologists, medical providers, and psychiatric providers; as well as setting treatment guidelines and standards for clinicians and trainees working with Trans clientele. Dr. Avi provides trainings for mental health professionals in the Southwest on best practices in working with transgender and gender nonbinary individuals.
As a member of the LGBTQ community, Dr. Avi know the importance of having a provider who is genuine, empathic, warm, and understanding of the issues others in the community face. They are also aware of specific challenges in finding appropriate and competent trans care providers, and work hard at reducing gatekeeping for those seeking transition services.
Client-focused in their therapeutic approach, Dr. Avi strives to provide a genuine, warm, and empathic environment to assist my clients in exploring their issues, develop alternative coping styles, and work to resolve problems in their life. They are enthusiastic about my work, and privileged to experience an individual's ability to rediscover their authentic self.
