Employment-Based Immigration Doubles from 1st October 2024
The new government fiscal year which starts on October 1, 2024 will be the best year ever for employment-based immigration.

Generally, 140,000 persons annually are able to get green cards through employment-based immigration. However, in the coming fiscal year, the number will more than double to over 290,000.

Because of the pandemic, U.S. Embassies abroad have been mostly closed, and this has prevented well over 150,000 relatives of U.S. citizens and green card holders from getting green card interviews. Our immigration laws provide that if the family-based quota of 226,000 is not reached, the unused numbers are transferred to the employment-based categories during the next fiscal year.

Back in September 2015, the wait for an RN born in the Philippines to get a green card in the U.S. was more than 10 years. In October 2020 to April 2023, EB-3 Philippines were "current" meaning no waiting time at all at that period (but again retrogressed now to Feb 2022). This news was especially good for registered nurses since health care employers in the U.S. can sponsor RNs for green cards without the necessity of advertising the job and going through the months-long PERM process. Other Filipino professionals will also benefit from the EB-3 category becoming current including (but not limited to): Physical Therapists, Occupational Therapist, Clinical Laboratory Technologists, IT Professionals, Engineers, Architects, Licensed Vocational Nurses, and Many More Occupations!!! But in May 2023 Visa Bulletin EB-2 & EB-3 for Philippines and other world countries have been again retrogressed.

US lawmakers recently introduced a bill for amendment of Immigration Act to lift the current seven percent country-cap for the issue of green cards. On becoming a law, the proposed bill will considerably reduce the waiting time of talented professionals who are eyeing permanent residency in the United States. Indians will benefit the most from US legislation to lift country-specific caps on green cards. This will help Indians to get into United States with lesser waiting time which is currently eleven to twelve years waiting period for Indians.

Persons born in a particular country cannot use more than 7% of the quota in each of the 5 employment-based (EB) categories. This has led to long backlogs in the EB categories for persons born in India, mainland China and the Philippines. But Current Country wide 7% quota of green cards may be removed if and when amendment Bill introduced in President Biden's Immigration Act 2021 is approved.

There will be an increase from 140,000 in the total number of available green cards in the Employment-based categories to 170,000 annually. Moreover, there would be an increase of EB-3 green cards by 30,000 in the unskilled worker category. There would be exemptions from numerical limits for Ph.D. degree holders from universities in the United States in science, technology, engineering, and mathematics (STEM fields).

H-1B visa alternative ‘OPT’ grew 700 percent in eight years:
Almost 1.5 million foreign students have been allowed to stay and work in the U.S. after graduation as part of a work permit program that is now larger than the controversial H-1B program for highly skilled foreign workers, according to a new report.
The number of students authorized to work under the “optional practical training” program has grown 700 percent since the federal government in 2008 increased the amount of time graduates with tech, science and math degrees could remain in the United States and work, according to a new Pew Research analysis of U.S. Immigration and Customs Enforcement data obtained through a Freedom of Information Act request.

The OPT program, which grew out of the Immigration and Nationality Act of 1952, essentially extends F-1 education visas for foreign college and university students so they can work during or after school. The program’s base-level permit lasts for 12 months, but a STEM extension allows participants to spend an additional two years working in the U.S., that means they can work for three years on OPT program.
