We will provide a detailed overview of the new laws we must comply with, so you can better understand the changes we are navigating and how they may impact you, our valued customers.
The State of Florida has not provided an example of the form they require. It would seem logical that if regulation is the goal, a standardized form for all massage establishments would be essential.
Effective July 1, 2024, Florida's House Bill 197 introduced new regulations for massage establishments, particularly concerning client intake procedures and identity verification. Key requirements include:
Client Information Recording: Before providing any service, establishments must collect and maintain legible records in English or Spanish for each client.
These records must include:
Full legal name, Home address, Telephone number, Date, time, and type of service or treatment provided.
Along with the Full legal name of the therapist who provided the service.
These records must be retained for at least one year after the service date.
(((( Client Identity Verification )))) Prior to delivering any service, establishments are required to verify the client's identity. This involves confirming the client's full legal name and home address, which can be achieved by reviewing a valid photo identification. A copy of the client's photo ID may be used to document this information.
So in the State of Florida you cannot get a massage without showing legal ID.
Inspection Compliance:
During inspections, officials will review records to ensure that establishments are accurately recording and verifying client information as mandated.
The State says the measures aim to enhance transparency and security within massage establishments across Florida.
The state mandates the completion of an intake form but fails to provide even a sample, let alone a standardized version. We urge state agencies to partner with us to ensure we can meet compliance requirements successfully.
