WHAT'S AT STAKE
On February 17, 2026, the NJ Division of Consumer Affairs issued an advisory confirming that the COVID-19 telemedicine waivers for Schedule II controlled dangerous substance prescribing have expired. As a result, all Schedule II prescribing — including methadone for opioid use disorder is now subject to a new requirement: an in-person visit with a prescriber every 90 days.
This rule, as currently interpreted, does not account for how OTPs actually operate. Our patients already come to the clinic in person daily or near-daily. They are not telehealth-only patients. Applying a blanket 90-day prescriber visit rule to this population creates unworkable burdens and real risks:
Stable patients would face mandatory quarterly in-person prescriber visits on top of their existing clinic schedule.
Patients in nursing homes, residential programs, and correctional facilities have no clear pathway to comply.
Disruptions to the prescribing cycle could interrupt dosing — with potentially devastating consequences for individuals in recovery.
