The Long Term Care Community Coalition (LTCCC) is a nonprofit, nonpartisan organization dedicated to improving quality of care, quality of life, and dignity for elderly and disabled people in nursing homes, assisted living and other residential settings. LTCCC focuses on systemic advocacy, researching relevant national and state policies, laws and regulations in order to identify relevant issues and develop meaningful recommendations to improve quality, efficiency and accountability. In addition to providing a foundation for advocacy, LTCCC uses this research and the resulting recommendations to educate policymakers, consumers and the general public. Consumer, family and LTC Ombudsman empowerment are fundamental to our mission.

Unlawful or poorly managed transfers and discharges are among the most common and distressing violations experienced by nursing home residents. These actions can lead to trauma, hospitalization, and even homelessness.

In the latest issue of the Elder Justice Newsletter, we highlight deficiencies where nursing homes failed to follow federal transfer and discharge requirements, putting vulnerable residents at serious risk:

🔹 Blue lips and unresponsive: Resident discharged without oxygen, arrives in medical crisis.
🔹 Medication confusion: Five residents discharged without medications or follow-up care.
🔹 Kicked out on Christmas: Resident discharged without proper notice.
🔹 “Never been homeless before”: Resident discharged to a homeless shelter.
🔹 “Walking with a Swiffer brand mop”: Resident discharged twice without equipment, care, or housing.

On August 25th, NY Attorney General James announced a significant settlement against a major New York nursing home chain, the Upstate Services Group, which operates 17 nursing homes across the state. The facility at the focus of this action, the Van Duyn nursing home in Syracuse, has a long history of horrifying reports of neglect and substandard care in the Syracuse Post-Standard.

Select Staffing Facts for Q1 2025:

🔸 The average U.S. nursing home provided 3.75 total nurse staff hours per resident day (HPRD), including 0.61 HPRD for registered nurses (RNs).
🔸 The staffing expectation model shows that 90.2% of nursing homes reported staffing levels below their expected HPRD.
🔸 The median nursing home fell 24.9% short of expected total nurse staffing levels and 42.3% short of expected RN staffing levels.
🔸 36% of facilities reported zero (0) presence of a medical director, despite federal requirements that a medical director oversee the quality of clinical care provided in every facility.
🔸 The average facility provided less than ½ minute per resident day of a mental health service worker’s time.

The Centers for Medicare & Medicaid Services (CMS) will increase Medicare payments to skilled nursing facilities by 3.2% in 2026, providing an estimated $1.36 billion in additional funding.

While providers welcome the increase, it is unlikely that these taxpayer dollars will result in much needed improvements to staffing and quality without meaningful oversight and accountability.
