Legislative Update and Call to Action….the abuses of the PBM industry in regards to patient access are so bad right now that you may have actually seen a 2nd bill on this same subject that has also been introduced called SB 99. In our opinion and from our current understanding, SB 93 and SB 99 both attempt to address the correct issues at hand here in regards to patient access and the major PBM abuses that are happening right now.

It is our position that the senate should pass the most stringent PBM reform bill of the two THAT THEY CAN ALSO GET THROUGH BOTH CHAMBERS OF CONGRESS AND BE SIGNED INTO LAW. The bill also needs to be fully enforceable regardless of whose name is on it whether that be SB 93, SB 99, or some combination of the two. So when you contact your reps on this, tell them this specifically….”WE NEED YOU TO PASS THE MOST STRINGENT, FULLY ENFORCIBLE PBM REFORM BILL BETWEEN THE TWO BILLS (OR SOME COMBINATION OF BOTH) THAT WILL ALSO MAKE IT THROUGH BOTH CHAMBERS OF CONGRESS AND BE SIGNED INTO LAW AS SOON AS POSSIBLE.”

The bill that is chosen could be a huge step in the right direction for patient access and pharmacy services in Alabama. Both APA and APCI have put a lot of work in on this and they deserve much credit regardless of which bill passes. AIPA and their team more recently have also contributed great ideas and great efforts. Again, the problem here is patient access and PBM abuses. The focus of both of these bills, in our opinion, is exactly where it needs to be!

…….and NO! NEITHER BILL IS A TAX! Both bills contain language strictly prohibiting that!

Here’s the deal….pharmacy in general and especially independent pharmacy is under attack in a number of ways in the current market most all stemming from companies that we generically refer to as PBMs.

In short, this bill protects patient access to locally available medication and patient choice of the pharmacy of your choosing (whether that be us or somebody else). There is no “tax” in this bill as other groups may try to manipulate the public into believing because they know Alabamians don’t want or need more taxes.

If you hear that, it’s simply not true. Furthermore there is language in this bill that specifically prevents PBMs from doing that. SB93 – The Patient Access Bill was introduced in the Alabama Senate today. PBMs and big business interests will do everything in their power to kill it, so your advocacy is critical. This bill will benefit every Alabamian. Tell your legislators, visit them in person, mobilize everyone in your community to do the same. We are stronger together!
