How does mediation begin? Depending on the type of mediation you are attending the mediation may begin differently. Some mediations begin with the parties all meeting in the same room and others begin with the parties in separate rooms. If the mediation begins with the parties in the same room the mediator will give a mediation statement explaining the mediator's role; each side may also be given the opportunity to provide an opening synopsis of their position on the case. Negotiations may follow or the parties may elect to separate into different rooms for private discussions with the mediator. If the mediation begins with the litigants in separate rooms, typically in family law mediations, the mediator will offer the explanation of the mediator's role to each party individually. The parties may, in either scenario, elect to have a joint meeting during the mediation process, however, this is not necessary or required.
