Okay here we go ..... FL rules changes for massage therapy that directly effect us as therapists and start on 7/1/24:
(sorry it's long but want to cover it all)
*- Anything that occurs within the establishment by anyone working there (regardless of there position) that is related to a criminal or sexual nature ..... that person AND the owner plus the D.E.M. will all be affected.
*- Advertising was changed to include the internet and various other means of transmission (not a surprise).
- Anyone that works within the establishment (including independent contractors or room lessees) are now considered "Employees" of that business and the owner is required to obtain and keep on file their name, address and other person info along with copy of their valid ID.
*- Changes were made to the definition of "Sexual Activity". The only thing of significance for that is as follows: intentionally touching the "femoral triangle", "buttocks", "mouth" or "tongue" along with a few other naughty places.
*- Also getting "written permission" to remove the draping which will expose the breast or genitalia.
*- A change to the visibility through a window from outside to inside of the reception area of the business. (i.e., no curtains, blinds, 100% reflective tinting, etc.)
*- All employees (remember that means EVERYONE) must be fully clothed at all times with nontransparent material (no fishnets or see through stuff).
*- As mentioned earlier - must maintain name, address, DOB, phone #, position and license (if applicable) of ALL "employees".
*- Maintain for 1 year the date, time & type of session, the LMT that provided session along with their license # ..... PLUS .... the full name, address, and phone #, a copy of valid form of ID from EACH client AND their session notes (i.e., medical documentation {SOAP notes}). So we are now officially REQUIRED to do SOAP notes on EVERY client.
*- Cannot "advertise" that you provide - prostitution, es**rt or sexual services ..... or post for services on a known "illicit website". (okay that's just stupid but whatever).
*- Cannot use the establishment as a permanent or temporary domicile or even "napping quarters", unless zoned residential. (Ah MAN! no more sleeping on the massage table).
*- They also seem to be making a big deal about the valid form of ID for each "employee", so better make sure everyone always has one handy..... or they can report your business to the federal Immigration Office.
