Diffusion tensor imaging in the courtroom: Distinction between scientific specificity and legally admissible evidence

11/22/2021

As of September 30, 2021, Mark D. Herbst, MD, PhD closed his radiology medical practice, St. Petersburg Independent Diagnostic Radiology, Inc., dba Independent Diagnostic Radiology, dba Independent-DR, Inc., dba SPIn-DR, Inc. Dr. Herbst extends his thanks and best wishes to all the referring physicians and attorneys with whom he has shared many great cases and helped many people. At this time, Dr. Herbst has retired from all clinical and medicolegal work. Indeed, he is retired from work of any kind. Whatever he does from now on would fall under the category of fun, not work.

Records from medicolegal reviews will not be preserved for retrieval. Medical records can be obtained by former patients from the imaging centers where their images were obtained or online at MorganRecordsManagement.com-->Patient Records Requests-->Request My Medical Records, by email at Medical@MorganRM.Com, or by phone at 833-888-0061. In accordance with applicable state law, you may be charged for the copying and transmittal of the records. There may be a transition period before Morgan Records Management has access to your patient records.

For a while, the length of which will remain flexible and undetermined, Dr. Herbst will be checking his email accounts and work voicemail (727-327-5006) intermittently for anything of interest. Maybe once a week or so? Who knows? If you want to pay an outstanding invoice, you should do that right away by check or by PayPal or by Google Pay.

So, if you would like to have a case reviewed, you are too late. If you need records, you are too late. If you want images, you are too late. If you just want to talk a little about problems you might have with a case, maybe you can catch him at the office while Dr. Herbst is writing his book, working on an article, erasing old hard drives, and destroying old records over the next few months. Go ahead and leave a message by email or voicemail. Maybe Dr. Herbst will get back to you about it. But don't hold your breath. Fun beckons.

We were going to be closed for a month anyway for my yearly SCUBA trip to Indonesia, but the trip was cancelled because of the pandemic. We got home last week and began a two week self-isolation. We plan to go back to work solo on about April 4th. That is about three weeks earlier than we expected. We were going to have to recover from jet lag for two weeks after our planned return in mid April.

Proud to be giving a lecture on Brain Trauma Imaging tomorrow for Trial Guides! If anyone out there is reading my once-every-two-year posts, I have a question. Would you buy a book written by me and published by Trial Guides?

After brain injury, the perception of whether or not a person has really changed depends on the direction of the change.

When someone changes for the worse, we see a totally different person. But what happens if the change is for the better?
