NYSABA would like to thank our Public Policy Committee for advocating for and working collaboratively with the State Education Department (SED) to help resolve a long-standing issue. Yesterday, SED released its long-awaited guidance on the use of unlicensed personnel in the ABA tiered service delivery model. We would like to thank CASP and Autism Speaks for their continued collaboration with NYSABA and for their ongoing advocacy on this issue and many other issues that impact the autistic community. It is important that all Licensed Behavior Analysts and Certified Behavior Analyst Assistants read and understand this new guidance. Updates

Public Policy Scope Expansion Update:

As of 6/30/23, the update to Chapter 818 of the Education Law took effect. Please read the following update carefully.

Changes include, but are not limited to:

Licensed Behavior Analysts may provide treatment to individuals diagnosed with a behavioral health condition in the DSM-V, pursuant to a prescription from an authorized prescriber. This does not change the NY Insurance Mandate that covers ABA for individuals who have autism.

Licensed Behavior Analysts must send a report to the prescriber once annually on the status of treatment.

NYSABA will host a Member’s Only webinar in the next few weeks explaining these and other regulatory changes. Please become a member to attend this important meeting. We will answer questions about scope expansion, the LBA exam, regulations, and more. Follow NYSABA’s social media for the date announcement and registration for this meeting.

On 11/22/22 Governor Hochul signed into law a bill to amend the ABA licensing law in NY. This amendment will bring us more closely into alignment with other states and allow for many who were awaiting licensure to move forward. NYSABA wishes to thank Governor Hochul, the bill sponsors Senator Stavisky and AM Glick, and our legislative champions, Assembly Leader Peoples-Stokes, and Senators Mannion and Skoufis for all of their efforts and support.

Although the implementation date is immediate, we do not yet know what the revised regulations will include. NYSABA will update its members as soon as we have more information.
