HB 4028 significantly reforms the audit process to give more rights to clinicians and providers by reducing the commercial insurer clawback window from 36 mos to 12 mos & gives state regulators a line of sight on medical management tactics such restrcting clinicians from using their judgement on the appropriate duration of client sessions.
Audits & clawbacks are incredibly punititve & have literally shuttered multiple agencies in Eugene alone. Clawbacks are when insurers take back money, despite successful treatment being provided to clients, often for unclear expectations or details, like something missing in a session note.
