Executive Order on Foster Care
Yesterday, the President and First Lady signed the Executive Order Fostering the Future for American Children and Families, outlining new federal coordination to improve the foster care system. Most of this work will be coordinated through the First Lady’s Office, as Melania Trump has chosen foster care as one of her focus areas for this final term.
Under this order, the US Department of Health and Human Services (HHS) will be tasked with modernizing the child welfare system, including through regulatory and reporting reductions, improving state and federal data collection and reporting, publishing annual scorecards measuring state performance on select metrics, and more. Additionally, HHS has been directed to attempt to overrule state-level requirements that LGBTQ+ children be placed in settings that affirm their identities. In addition, the order requires HHS to explore how to increase flexibility within the Chafee Educational and Training Voucher program. Other agencies are expected to provide additional support for current and former foster youth, coordinated through the First Lady’s Office.
The other primary element of this executive order is the creation of the First Lady’s Fostering the Future Initiative. This is a proposed public-private partnership where interested employers, institutions of higher education, and non-profits can commit to supporting individuals in or transitioning out of foster care. Several out-of-state universities, including Vanderbilt University and the University of Miami, have already pledged new scholarships to support former foster youth. The White House also plans to publish a website connected to the initiative to help foster youth access and navigate public benefits, including housing, healthcare, mentoring, and more.
DCY to Begin Updating Adoption Rules
The Department of Children and Youth (DCY) has officially shared that work has begun on its planned update to its adoption rules (OAC 5180:2-48). This work will start with a smaller subset of the rules, listed below. DCY is requesting feedback from adoption providers about the current rules to help inform what updates should be made. If your agency provides adoption services, we would encourage you to share any thoughts or feedback with the department using this form by November 24, 2025.
