What is the difference between litigation and mediation in a personal injury case? Litigation is a formal court proceeding before a judge and potentially a jury. It occurs when a case is not settled in a timely manner or cannot be settled. Litigation may include hearings and a trial, at the end of which the judge or jury determines the outcome. Mediation is a third-party process that is completed privately outside of the court system. A mediator acts as a neutral party, hearing arguments and evaluating evidence from both sides.
