Public Health Emergency (PHE)
At the beginning of the COVID-19 pandemic, the federal government declared a public health emergency (PHE). During the PHE, we are required to continue SoonerCare coverage for all members even though there are some members who no longer qualify for benefits.

Example of reasons why a member may no longer qualify for benefits:

Your salary is now higher than the required amount to receive SoonerCare benefits.
Someone has moved in or out of your household.
Your contact information and/or documents are not updated at mysoonercare.org.
It was recently announced the PHE is extended another 90 days. This means members, who typically wouldn’t qualify for benefits possibly due to the reasons above, will continue to receive their SoonerCare benefits until October 31st.

There will come a time when the PHE will end. Once we know the day, we will send notifications to those people who no longer will receive SoonerCare benefits. Those members determined to be ineligible for benefits will be removed from SoonerCare in phases focusing on the member’s benefit utilization and critical health issues.

Members who are ineligible will receive three notices:

An initial notification letter will be mailed once the end of the PHE is announced. This notification letter will detail the specific end date of benefits for those determined ineligible. It is important you update your mailing address at mysoonercare.org as soon as possible, so you receive this notification.
A second notice will be sent to ineligible members 45 days prior to their scheduled end date to inform them of the reason for loss of eligibility, potentially missing documents to verify eligibility and appeal rights.
A third notice will then go out 10 days before the ineligible member loses eligibility.
Members should take time to think about their health care needs and plan in case their SoonerCare coverage ends. Please go to mysoonercare.org to learn more.

Our organization NAHU (National Association of Health Underwriters) encourages members and non-members to reach out to their federal legislators and ask them support legislation presented by Senators Mark Warner (D-VA) and Rob Portman (R-OH). They have introduced S. 3673, also known as the Commonsense Reporting Act, this week. This is bipartisan legislation to improve the difficult ACA reporting requirements for the employers. Please urge your senators to support this bill and ask your friends and peers to take action as well.

There is a new SEP (special enrollment period) available to lower-income consumers who have an estimated annual household income between 138 - 150% of the federal poverty level, allowing them to enroll in ACA marketplace coverage any time, if eligible.

The new federal prohibition on surprise billing went into effect on January 1, 2022. The new rules prohibit providers from charging out-of-network rates for emergency care, air-ambulance services and all care by an out-of-network provider in an in-network facility. On September 17, 2021, the Centers for Medicare & Medicaid Services (CMS) finalized a series of provisions that follow through on President Biden’s commitment to build on the Affordable Care Act, expand health coverage access for Americans and advance health equity. The provisions are the third installment of the payment notice for 2022.

There are several important policy updates that Marketplace agents and brokers should be aware of prior to the beginning of the plan year 2022 Open Enrollment Period (OEP). These provisions include:

An extension of the OEP from November 1, 2021, to January 15, 2022, annually for Marketplaces on the federal platform.
Clarification for Special Enrollment Period (SEP) rules regarding enrollees who qualify for a maximum advance premium tax credit (APTC) amount of zero dollars.
A monthly SEP for APTC-eligible individuals whose household income does not exceed 150 percent of the federal poverty level (FPL).
Clarification on the full range of Direct Enrollment (DE) and Enhanced Direct Enrollment (EDE) options available for OEP. Note: DE and EDE will be fully available for the upcoming OEP, and in 2022, for Federally-facilitated Exchange (FFE) states. There are no changes to the current operations of the federal DE and EDE pathways.
This final rule demonstrates a strong commitment by the Biden-Harris Administration to expand health insurance coverage to more Americans and make it easier and more affordable to obtain coverage.
