We're gathering signatures to put the CI-128 Constitutional Amendment to the ballot to protect Montanan's reproductive rights. If you haven't registered, don't worry. we can help sign you up too.

*CI-128 would amend the Montana Constitution to expressly provide a right to make and carry out decisions about one's own pregnancy, including the right to abortion. It would also prohibit the government from denying or burdening access to an abortion when a treating healthcare professional determines it's medically indicated to protect the pregnant patient's life or health. CI-128 prevents the government from penalizing patients, healthcare providers, or anyone who assists someone in exercising their rights regarding their pregnancies.

We have some more good news to share! On Tuesday, a Montana District Court judge granted abortion provider’s request for a preliminary injunction to block several restrictions on abortion access. This decision bars the state of Montana from enforcing new abortion restrictions while cases over their constitutionality continue.

The restrictions blocked today include:
- HB 544 and a rule from the Montana Department of Public
Health and Human Services (DPHHS) that would effectively
eliminate abortion access for most Medicaid patients in the
state.
- HB 862, a law that would prohibit the use of public funds for
abortion care in almost all cases.

While this fight is not yet over, we are grateful that Montanans can still access vital, medically necessary, and potentially life-saving reproductive health care services without being turned away due to their income and insurance status. Pregnant people who rely on Medicaid deserve the same access as every other Montanan to the full spectrum of reproductive health services, including abortion.

Thanks to the ACLU of Montana, the Center for Reproductive Rights, the Planned Parenthood Federation of America, Planned Parenthood of Montana, Blue Mountain Clinic, and All Families Healthcare’s very own, Helen Weems for their tireless work to ensure these restrictions are blocked.

We have some exciting news to share — a ruling was issued in the Weems v State court case, featuring All Families Healthcare’s very own Helen Weems! The ruling affirms that advanced practice nurses like Helen are qualified to legally provide abortions in Montana; the court also took this opportunity to reaffirm the Armstrong v State decision from 1999, in which they found abortion to be a medical decision protected by the state’s constitutional right to privacy. There have been highs and lows as this case has worked its way through the courts over the past 6 years, and we're so grateful for the work done by the MT ACLU and the Center for Reproductive Rights who represented Helen in this case, for the coverage that journalists across the state have given to its developments throughout the years, and for the support of our fellow abortion providers and community members in Montana and across the country.
