In the fall we hosted a Women's Health and Wellness event to coincide with Breast Cancer Awareness Month. Novant Health’s mobile mammography bus was on-site at the event to offer access to breast health services.

Novant Health and New Hanover Regional Medical Center are prepared for the storm with ample supplies on hand and safety precautions being put in place. All our Coastal region emergency departments will remain open.

At this time, we are planning to delay opening of our outpatient services, including lab and radiology locations, with Saturday hours, to 10 a.m. on Saturday.

Remember that squat challenge I did last month? Well I made good on my commitment to donate $1500 to benefit cancer patients but I did it with a twist!

To ensure that my local community benefited directly from my squat effort I decided to contact my friend Courtney of ComfyChemo Chemowear Apparel and Novant Health New Hanover Regional Medical Center Zimmer Cancer Center to provide shirts to select patients receiving chemotherapy. These shirts were specially designed to ensure that chemotherapy patients receive their treatment with dignity, and of course comfort!

Thank you to Zimmer Cancer Institute for all that you do for our cancer patients here in South Eastern North Carolina and thank you to ComfyChemo for making some of the most stressful moments for cancer patients a little more bearable!

PLEASE HELP STOP THIS INJUSTICE! AND COVERUP OF MY PHI BREACH PLEASE!

I HAVE CAUGHT NOVANT HEALTH TRYING TO INCLUDE ME IN THE UNLAWFUL TEXTING TO SKIRT OPEN RECORDS LAWS AND CONCEAL THIS BREACH OF MY PHI that i have been reporting for weeks now. I HAVE BEEN SYSTEMATICALLY IGNORED BY THE PRIVACY OFFICERS AND ECEP AND THEY WILL NOT PROVIDE TO ME SUPERVISOR NAMES OR COMPLAINT FORMS AND MOST OFF I FEEL THERE'S A CONSPIRACY BETWEEN NOVANT HEALTH AND ECEP AND FINANCIAL DATA SYSTEMS, SOMETHING JUST ISN’T RIGHT.

PLEASE HELP DELIVER THIS COMPLAINT TO THE APPROPRIATE PARTIES AND STOP THIS COVERUP UP!

October 13, 2022, I contacted Novant Health to notify them that a breach had occurred of my PHI that had originated from one of their facilities stemming back to 2017 emergency room visit in OGDEN LOCATION.

I spoke with an unknown individual and left a message containing my complaint that this PHI breach had occurred and details of that complaint.

I contacted Novant Health again a couple of days later and at that time left a voicemail summarizing my complaint in detail, the same information that I gave to Novant Health on October 13, 2022 detailing my complaint and report of my PHI breach to Novant Health New Hanover Regional Medical Center.

On October 29. 2022, I received a telephone call from Candace Wells Van Hagey. Candace informed me that she was following up on the complaint regarding my PHI breach and also we discussed other issues that were a part of the complaint as well. She stated that she would investigate. I assumed she would investigate all the issues that I reported in my complaint to her.

I informed Candace Wells Van Hagey, Privacy Officer, for NHRMC at that time that a third party collection agency had provided to me by mail what appeared to be a statement of some sort containing unlawful PHI over and beyond what is permitted to be disclosed to a third party collection agency and it was to the utmost concerns to me how this collection agency came into possession of this unlawful PHI that is regulated and governed under the The Fair Credit Reporting Act (FCRA) and the Health Insurance Portability and Accountability Act (HIPAA)

I also informed Candace Wells Van Hagey, Privacy Officer, of other felonious action by a third party collections agency called Financial Data Systems regarding a letter they sent to me along with that unlawful PHI document that was provided to them (Financial Data Systems) by ECEP, II, PAI found out later by talking to the Administrator of ECEP, II PA.

The collection letter that was sent to me was mailed August 26, 2022 from Financial Data Systems and contained content that was also unlawful per The Fair Credit Reporting Act (FCRA) and the Health Insurance Portability and Accountability Act (HIPAA), and North Carolina Laws.

It is agreed that PHI can be given to a third party collections agency but only to the extent necessary to collect the debt and shall not have any PHI other than the entity name, date of service, amount of bil, and and due date.

This PHI had individual physicians names, twice, and had a services section of the services rendered to me although the content appeared to be typed over with X’s but you can still see there was relevant data under the type cover.

Not only did Financial Data Systems contain the unlawful PHI document that they received from ECEP, II PAThe letter also contained verbiage that is unlawful as it was or threatening, deceptive, coercion, and ridiculed me for disputing those two debts they were trying to collect.

Three times Financial Data Systems admitted they never had validation documents for those two collections but after five years admitted they just contacted their client ECEP, II, PA. I’m assuming as the letter states, and they provided to them this unlawful document.

October 30th passed and quickly i received an email from Vera Newkirk, another privacy officer employed at Novant Health New Hanover Regional Medical Center stating that the issues were escalated to her by Candace Wells Van Hagey, the other privacy officer that took my initial complaint back mid October of 2022 never wrote me again nor returned any of my emails to her that was sent to her directly or directly as I attached a copy of emails sent to Vera Newkirk and to Kim Skaggs throughout the past four weeks. Over 30 emails were sent to or was a copy to an email I sent to Vera Newkirk, privacy officer of Novant Health New Hanover Regional Medical Center and to Kim Skaggs, administrator of ECEP.

I have continued to email Candace Wells Van Hagey, Vera Newkirk, with NOVANT HEALTH, and Kimberly Skaggs, Administrator for ECEP, II Pa, and never once did any of the three ask that I do not email anymore and never once did they provide to me their supervisor or a complaint form and the procedure for filing a complaint.

My PHI was breached back as far as 88 days ago when we knew that Financial Data Systems had in their possession and mailed a copy to me.

It’s been approximately 32 days ago that I reported this breach of my PHI and the other crimes committed by Financial Data Systems, and well over three weeks that Vera Newkirk and Kim Skaggs with ECEP learned that my PHI had been breached including the other violations by Financial Data Systems as I provided the facts to all of them and not action has been taken thus far.

It is unlikely that I am the first person in history to have their PHI BREACHED between ECEP, II PA., and i demanded an immediate investigation into the practices of and the relationship with ECEP AND NOVANT HEALTH, because you would think that with my rights violated in multiple instances at the hands of this third party collections agency that ECEP would cease and withdraw the how many thousands of collections they are collecting for NOVANT HEALTH AND ECEP, AND HOW MANY OTHERS HAVE HAD THEIR RIGHTS VIOLATED AND COULD NOT FILE A COMPLAINT BECAUSE I HAVE BEEN REFUSED A COMPLAINT FORM AND PROCESS FOR FILING A COMPLAINT TIME AND TIME AGAIN BY ALL PARTIES.
Kim Skaggs contacted me on Thursday November 17, 2022, and asked that I “Get Vera Out’ AND ‘Get the HOSPITAL OUT OF THIS if i would’ THAT THE LIABILITY IS BETWEEN ECEP AND FINANCIAL DATA SYSTEMS. This was probably due to the fact that I had complained about illegal use of ‘TEXTING’ with Candace regarding my PHI BREACH.

IT IS ILLEGAL FOR A TEXT APP TO BE USED THAT IS NOT IN CONFORMANCE WITH THE LAW REGARDING END TO END ENCRYPTION, ETC. There are specific laws that govern the use of text messages and when Candace Wells Van Hagey asked me to use her text number I immediately called foul and that’s when communication ended with me and Novant Health.

The only reason that I can think why they would have done this is to conceal the breach and keep it from being protected under the open records law. THERE IS NO JUSTIFCAITON WHATSOEVER FOR THAT TO HAD TAKEN PLACE. IT IS ABSOLUTELY ILLEGAL.
There is no justification for not one person at NOVANT HEALTH OR ECEP, to provide to me a compliant form to file a complaint properly so that it is given the proper attention and in a reasonable amount of time. It is illegal for NOVANT HEALTH OR ECEP NOT TO Provide to me the records of my PHI THAT i have requested.
The NOTIFICATION RULE HAS BEEN COMPLETELY IGNORED. THE PROTECTION OF MY PHI HAS BEEN THROWN OUT THE WINDOW FROM DAY ONE AND IT APPEARS TO BE A MAJOR CONSPIRACY BETWEEN THE THREE ENTITIES IN THEIR EFFORTS TO NOT ADDRESS THE BREACH OF MY PHI.

I HAVE BEGGED FOR THE STATUS AND I HAVE BEGGED TO REMOVE MY PHI FROM THAT COLLECTION AGENCIES CRIMINAL HANDS. I HAVE ASK FOR SUPERVISORS NAMES AND NUMBERS AND HAVE BEEN TOTALLY IGNORED.

WHEN I WAS ASKED TO LET VERA OUT AND TO LET NOVANT HEALTH OUT BY ECEP, I FELT THEN THIS WAS A CONSPIRACY IN THE WORKS BECAUSE OF THE AFFILIATION, THE OWNER OF ECEP HAS HIS OWN PAGE ON NEW HANOVER HOSPITALS WEBSITE SO IT IT ALL UP FOR SPECULATION AT THIS POINT BUT I NEED HELP ON THE STATE AND FEDERAL LEVEL IN PROTECTING MY RIGHTS FOR THIS NIGHTMARE THEY ARE ALL PUTTING ME THROUGH.
I followed up with an email to KIMBERLY SKAGGS REGARDING THAT CONVERSATION AS I HAVE CONTINUED TO DOCUMENT EVERY CONVERSATION AND EVERY REQUEST THAT HAVE ASKED IN WRITING AS WELL VERBALLY HAS BEEN SYSTEMATICALLY IGNORED.

I have literally begged and pleaded with any of the three to please file a report and secure my PHI and give me an update. NOT ONE TIME IN THE 88 DAYS SINCE MY PHI HAS BEEN BREACHED HAS ANYONE FILED A COMPLAINT OR FOLLOWED THE LAWS AND POLICIES REGARDING A BREACH WHETHER IT IS 1 PERSON OR 500. This has been the most blatant disrespect for my rights, disrespect for my privacy, disregard to so many laws both state and federal, and absolute derrick of duties from the two privacy officers of NOVANT HEALTH, AND Administrator KIMBERLY SKAGGS with ECEP.

Financial Data Systems still has my PHI, ECEP is still chillin, and NOVANT HEALTH NO WORD FROM them since i caught them trying to use the text cover up with me, FDS still trying to collect those miserable debts they have never properly validated.
I HAVE DOCUMENTATION TO SUPPORT EVERY CLAIM IN THIS COMPLAINT. PLEASE HELP ME GET THIS TO THE APPROPRIATE PERSONS AND HELP ME DECIDE ON WHAT LAWYERS I NEED TO CONTACT TO PICK UP FORM HERE AND REPRESENT ME
This is of extreme urgency. This needs to be shared with everyone that may have a collection with FDS and ECEP AND NOVANT. I feel an audit needs to take place immediately so as to protect all the other thousands and thousands of patients like me that have been destroyed by FDS AND ECEP! THIS IS A MAJOR INJUSTICE THAT IS DESTROYING PATIENTS CREDIT AND SUBJECTING THEM TO HEINOUS CRIMES.
