LIMUSA RESOLVES ON AMALGAMATION

Liberated Metalworkers Union of South Africa (LIMUSA) is delighted to announce a resolution to Amalgamation under National Union of Mine workers (NUM) was adopted in virtual National Congress held on 27th June 2020. In discussion led by COSATU CEC the two unions have been in discussions about on the application of a COSATU principle of "one industry one union" since 2018. The discussion guided by the COSATU longstanding resolution of merger and amalgamation of the trade unions operating in same, similar, overlapping industries to strengthen the bargaining power of the workers.

As a democratic and worker controlled union we had been engaging structures and general membership to seek mandate on amalgamation question extensively in 2019. Majority of the members supported the Amalgamation which necessitated National Congress to be convened. Due to Covid-19 pandemic and subsequent Lockdown regulations the union decided use technological innovations to convene a virtual National Congress on 27th June 2020. The virtual National Congress connected delegates from across seven (7) provinces in the country to deliberate on the amalgamation.

The Congress unanimously agreed on the amalgamation as new strategy to be adopted to ensure the initial objective of keeping metalworkers in COSATU is strengthen even more. Central objective of the Amalgamation is unity of workers, improved service to members, strengthening of NUM and our federation COSATU.

The congress also commemorated and paid tribute to our fallen heroes our founding President and General Secretary comrade Sifiso Maphumulo and comrade Cedric Gina for their remarkable contribution in working class struggle in general and metalworkers struggle in particular.

We are looking forward to working together with NUM leadership and structures to build united and stronger trade union organization of Elijah Barayi to fight the exploitation of workers at all manifestations our industry

DENEL FAILS TO PAY FULL SALARIES

Liberated Metalworkers Union of South Africa (LIMUSA) is highly concerned with the ongoing crisis in Denel predominantly caused by its Executives. Workers were only informed via work email at 20:09 p.m. on the evening of the 24th of June 2019 that they will only be paid 85% of their salaries on the 25th June 2019 but that has not materialised, even to the promised FNB Account holders as per the communication at time of issuing this statement.

There is no Denel employee who has been paid their salary and an employee-employer contract has been breached because it is stipulated on their contract that employees will be paid on 25th of each month.

This recent development is not only unlawful but also irresponsible and unprofessional on part of Denel Management to have failed to timeously inform workers on the possible short pay in salaries as per their promise to communicate by the 14th of each month.

It is our considered view that this crisis, self-inflicted by Denel Board and Senior Management, as it is alleged that Group CEO Mr Du Toit to date, besides his monthly salary, has received R600 000 relocation fee, R1.5 Million (R750 000 in Mid-February and R750 000 in Mid-April) and it is also alleged that he is expecting approximately 50% (= approximately R 2.5 Million) of his Annual Income in June as per his KPAs, set by the Denel Board.

These exorbitant and unjustified millions are spent on a Group CEO which has nothing to show in terms of turning the organisation around, stabilising the financial challenges facing Denel and holding any Denel Executive or Senior Manager accountable especially those implicated in the Zondo Commission Investigation. Yet, the aforementioned Executives or Senior Managers are still holding their respective Executive or Senior Management positions and influencing company decisions.

We also are informed that millions been spent on companies like; Altimax (Pty) Ltd Chartered Accountants & registered auditors, Bowman Gilfillan Attorneys, PwC (PricewaterhouseCoopers), Mr. Wim de Klerk (“Volunteer” CFO) and Mr. Willem Nel (Interim Group Supply Chain Specialist).

It is once again alleged that the Company procurement policies and procedures as well as the PMFA (Public Finance Management Act) and Regulations has been breached in appointing the above mentioned companies and persons.

Denel should take responsibility for any cost implications to workers as a result of irresponsible and unprofessional last minute notification. Denel must pay all incurred costs or penalties due to unpaid debit orders, all the costs to employees and we also expect them to pay the interest accrued on the 15% salary balance as Section 75 of the BCEA. We shall seek commitment as to when the remaining 15% of worker salaries will be paid.

It is very suspicious and concerning that Denel doesn’t even have a Company Secretary and/ or it hasn’t been advertised as stipulated in the Company’s Act.

We further want to call on the Denel Group CEO to take responsibility for having failed on his duties to effect a turnaround strategy which has now resulted in the non-payment of salaries. Due to his dismal performance, Denel Group CEO, Mr. du Toit should render his resignation with immediate effect. Furthermore, the Denel Board is expected to account for the wasteful expenditure.

LIMUSA calls for Metalworkers to join COSATU May Day

Liberated Metalworkers Union of South Africa (LIMUSA) calls on all metalworkers to attend COSATU May Day rallies that will be held nationwide on the 1st May 2019. COSATU as the biggest Federation in the county is set to have rallies in all Provinces around South Africa to celebrate this historical workers Day. The main rally will be in Durban.

We call on all workers in the country and the world never to take for granted the significance of this day in the struggle of workers. The rights that we have today were as a result of a protracted struggle of workers worldwide and many workers lost their lives in fighting for the rights we enjoy today.

COSATU has always been with workers in the trenches throughout the struggle for better working conditions in the workplace and for political freedom. COSATU has been in the forefront of the struggle for this day and confronted the Apartheid regime to have 1st May declared a holiday in South Africa.

In the 25 years of democracy COSATU has been on a continuous struggle that brought about Labour Relations acts, recognition of Trade Unions in all Sectors and other related laws which is much hated by the capitalist bosses. It is under the leadership of COSATU that we now witness a historical introduction of the National Minimum Wage act.

We call on workers to join us in the celebration for gains achieved by workers and mobilisation for further struggles to be pursued by workers, because “Power concedes nothing without demand” said Frederick Douglass.

For details of rallies in your province please contact COSATU Provincial Office.

Workers of the World Unite, You have nothing to lose but your chains!!

South African Communist Party

Statement, 28 January 2019

*SACP conveys deepest condolences to the family of Comrade Cedric Gina, former General Secretary of Limusa and former President of Numsa*

The South African Communist Party (SACP) conveys its heartfelt condolences to family of Comrade Cedric Gina, who died in the early hours of Monday, 28 January 2019.

Comrade Cedric Gina was the founding General Secretary of the Liberated Metalworkers Union of South Africa (Limusa) and a former President of the National Union of Metalworkers of South Africa (Numsa). He was also a member of the African National Congress (ANC) and the SACP.

A committed trade unionist, Comrade Cedric rose through the ranks of the progressive trade union movement to play a pivotal role in mobilising metalworkers in their daily struggles for better working conditions. He will also be remembered for his commitment in the building and strengthening of the Congress of South African Trade Unions (Cosatu), even during Cosatu’s most trying times. He stood for the unity of workers in general and within the umbrella of Cosatu in particular and opposed the division of the federation with the full understanding that competition between and among workers can only serve the interests of the exploiters, the bourgeoisie.

The SACP also conveys its condolences to metalworkers in general and the workers of South Africa as a whole for the loss of a working class activist and trade unionist.

In his memory, the SACP calls for the deepening of unity within the ranks of South African workers in the fight against capitalist exploitation. The SACP further calls for the strengthening of our Alliance through the already agreed reconfiguration process especially towards, but more importantly beyond, the 2019 general election.

Swazis are once again robbed: Tribute to Comrade Cedric Sabelo Gina
The Swazi struggle is once again robbed of one of its most dedicated internationalist. The passing away of Comrade Cedric Gina is a huge blow to the people of eSwatini in their struggle for democratic change.
Under his leadership as president of the National Union of Metalworkers of South Africa, Cde Gina ensured that NUMSA played a leading role in rendering practical solidarity to the people of Swaziland under their movement the Peoples United Democratic Movement (PUDEMO) and the trade union movement under the banner of the Trade Union congress of Swaziland (TUCOSWA).
It was during his tenure that practical solidarity was rendered in the form of training, solidarity activities and campaigns against the autocratic regime of Swaziland. It was under his leadership that his then union rendered practical solidarity in all formed to realise the slogan of TUCOSWA of one country one federation, one industry one union by releasing all forms of resources; financial, human, technical and otherwise to assist in the most challenging merger process the country has ever seen; the merger of ten unions to form the now vibrant Amalgamated Trade Unions of Swaziland (ATUSWA).
At the peak of international lobbying against the regime, cde Gina was deployed to form part of a team of international trade union leaders that engaged the European Parliament, resulting in more decisive actions by that parliament against Swaziland oppression. On behalf of the movement(PUDEMO) leadership Comrade Gina represented the people of Swaziland in the International Solidarity Conference convened by the World Federation of Trade Unions (WFTU) in Strasbough France, in 2012; resulting in consensus of the global trade union movement in support of the struggle for democracy in Swaziland.
Under his leadership as General Secretary of the Liberated Metalworkers Union of South Africa ( LIMUSA) the struggle of the people of eSwatini received even greater attention within COSATU, the ANC and all its allies.
He remained till his last moments a dedicated cadre of the mass democratic movement of South Africa, a friend of the Swazi people and a stalwart of the trade union movement.
At a personal level I am humbled that he invited me to join the international department of then COSATU’s largest affiliate. He continued to guide, educate and nurture many of us. Due to our similar looks I called him my twin and many would mistake me for him.
We send heartfelt condolences to his family, his union LIMUSA, former colleagues and comrades at NUMSA, COSATU, his movement the African National Congress and whole the tripartite alliance.
May his revolutionary spirit continue to inspire his comrades towards victory in the 2019 General elections
We are poor without you President, General Secretary, my twin.
Rest in revolutionary peace
