Department of Labour is currently busy with an inspection to determine whether the employer complies with requirements of the Basic Conditions Act and other related acts including the Occupational Health and Safety and Employment Equity Act.
We can assist you to update your current employment contracts and review all employment policies Aquovadis is a Member of the AHI Employer Organizations and can represent Employers in all in the CCMA and Bargaining Councils. Be initiative-taking and avoid unnecessarily compliance orders that could result in fines and or CCMA disputes.
The occupational health and safety Act is applicable to all employers. When the department inspects the workplace they require proof of legal appointments, trained First aiders, safety officers and representatives as well as a safety file as proof that the employer complies. The Department of Labour has also undertaken to “name and shame” those organisations which have not complied with the provisions of the Act.
Inspectors are checking for compliance with the Employment Equity Act by scrutinising
whether designated employers are implementing EE plans and applying affirmative action measures to end unfair discrimination in the workplace.
Inspectors are also checking the company’s workforce profile in comparison to the national economic active population demographics to establish equitable representation, workforce movement in relation to recruitment, promotion, termination, and skills development.
Defaulters may be prosecuted and if found guilty be fined for the first offence is:
R1.5 million or 10% of the employer’s annual turnover (whichever is the greatest); and/or
10 years imprisonment

Following a ruling in the Constitutional Court and subsequent publication on
10 March 2021 in the Government gazette must all employers whom the employee
Domestic workers, including gardeners, must be registered with the Workmen’s
Compensation Fund. Registrations must be done no later than March 2022, after which
Employers who are registered can be fined by the Department of Labour

Mandatory Registration for Workmen’s Compensation of Domestic Workers.

The government has gazetted new rules for domestic workers in South Africa, which will see them covered under the Compensation for Occupational Injuries and Diseases Act (Coida)

Do you have a Domestic Worker at home?
All employers of domestic workers – whether part-time or full-time – must register themselves and their employees with the Compensation Commissioner.

Aquovadis can assist you in the process of registering yourself and your employee/s.

We also offer the following services for Employers employing Domestic workers:
• Drafting Contract of Employment (After the implementation of the National Minimum Wages and amendments to the Basic Condition Employment Act we advise that Employers review their contracts to ensure that they are in line with the relevant legislation)
• UIF Registrations (We register Employers for UIF and submit the UIF declarations Monthly.)
