WORKING AT HEIGHTS – SAFETY IS THE LAW
Falls from heights remains one of the leading causes of serious injuries and fatalities in the workplace. In terms of the South African Occupational Health and Safety Act (OHS Act 85 of 1993), BOTH THE EMPLOYER AND THE EMPLOYEES have legal duties to ensure a safe working environment.
EMPLOYER RESPONSIBILITIES
Employers must:
‼️Provide a safe working environment and safe equipment
‼️Ensure proper fall protection plans and risk assessments are in place
‼️Supply suitable PPE and safety harnesses
‼️Provide training, supervision and competent persons for working at heights
‼️Ensure scaffolding and ladders are inspected and safe to use
EMPLOYEE RESPONSIBILITIES
Employees must:
‼️Follow safe work procedures
‼️Use safety harnesses and PPE correctly
‼️Report unsafe conditions immediately
‼️Work responsibly to protect themselves and others
WORKING AT HEIGHTS REGULATIONS
According to the Construction Regulations:
Fall protection is generally required where there is a risk of falling from a height of more than 📢❗️2 metres
A Fall Protection Plan is 📢❗️mandatory where persons work at height
Workers exposed to fall risks 📢❗️must use suitable fall arrest equipment and PPE
Workers 📢❗️must be medically fit and trained for working at heights
Unsafe scaffolding and 📢❗️lack of fall arrest systems are prohibited
Employers 📢❗️must appoint competent persons to supervise height work
PENALTIES FOR NON-COMPLIANCE
Failure to comply with OHS legislation can result in:
💸Department of Labour fines reaching hundreds of thousands of rands
⚖️Possible imprisonment for serious negligence
🚫Stop-work notices and business shutdowns
💶Civil claims and compensation costs following injuries or fatalities
INJURIES YOU CAN SUSTAIN FROM A FALL:
A fall from as little as 2 metres can cause severe or life-threatening injuries, especially if the person lands awkwardly or strikes objects during the fall:
