What Happens If I Refuse A DOT Alcohol or Drug Test?
You will be immediately removed from the performance of any safety-sensitive function until you complete the Return-to-Duty Process.
You will need to see a DOT-qualified Substance Abuse Professional and comply with the education and/or rehabilitation requirements.
You could have a hard time finding another job.
You must complete the Return-to-Duty Process, including directly observed tests, and you may have to pay for those tests
Your certificate, license, rating, or authorization may be revoked, suspended, or restricted.

What is the minimum number that can be in a consortium?
A consortium can have as little as two drivers. An owner-operator must be in a consortium with at least 2 drivers in that consortium. Most consortiums have more than 2 drivers, but they have to start somewhere. With the DOT consortium for FMCSA, annual testing rates must be a minimum of 50% for drugs and 10% for alcohol. So, with a two-person consortium, one person will need to be selected for drugs and one person will need to be selected for alcohol. Rounding up is always required to meet the minimum random testing requirements.

As time goes on a smaller consortium will grow to a larger consortium. Employers with a small number of drivers will always want to be in a consortium. Employers with large numbers of drivers will be better served with a stand-alone random testing pool of their own drivers. This is not a regulation, but a general rule of thumb. It is ok if you have over 20 drivers and you still want to be in the consortium random testing pool.

Any number greater than one can be in a consortium. An owner-operator must be in a consortium. The consortium is a grouping of owner-operators and other companies combining all drivers into one testing pool. A company with 2 drivers or hundreds can be in a consortium pool for DOT drug and alcohol testing. There is no maximum number for the DOT drug & alcohol testing consortium.

Can I use over-the-counter medications and perform DOT-covered functions?
Prescription medicine and OTC drugs are allowed; however, you must meet minimum standards:
The medicine is prescribed to you by a licensed physician, such as your personal doctor.
The treating/prescribing physician has made a good faith judgment that the use of the substance at the prescribed or authorized dosage level is consistent with the safe performance of your duties.
Best Practice: To assist your doctor in prescribing the best possible treatment, consider providing your physician with a detailed description of your job.
The substance is used at the dosage prescribed or authorized.

If you are being treated by more than one physician, you must show that at least one of the treating physicians has been informed of all prescribed and authorized medication and has determined that the use of the medications is consistent with the safe performance of your duties.

Taking the prescription medication and performing your DOT safety-sensitive functions is not prohibited by agency regulations.

Oral Fluid Drug Testing - When Can It Be Used?
This type of test is only for non-DOT drug testing and has been around for over 10 years.
There are some significant advantages to oral drug testing such as:

* The specimen collection is always observed
* It is very difficult to cheat on an oral fluid test
* Special requirements for an oral fluid collection facility are not needed (like a restroom)
* There is the ability to detect drugs very quickly after they have been absorbed into the body
* Cost savings when oral fluid collections are done by the employer
With ma*****na being legal in many states either medical or recreational; the short detection time in oral fluid testing becomes important. Employers want to know if the employee is under the influence of ma*****na at work.
